Seminar *The criminal intent

The criminal intent, by its nature, is an internal psychological behavior in which the will is directed
to commit the crime. The criminal judge depends on the circumstances and circumstances of each
incident or crime separately, since there is generally no specific standard set by the legislator on which
the criminal judge can rely. Therefore, the latter often encountered difficulty in the exploration of
criminal intent, as the external physical behavior may not be sufficient to infer the intent of the crime,
but the legislator in spite of this difficulty has stipulated in some crimes, especially serious ones must
be manifested intent Re In addition to the general criminal intent expressed by the motive or the
purpose of committing the crime, in violation of the general rule in the criminal law, which requires not
to abuse the motives in the conduct of the crime. Therefore, we proposed to the Iraqi legislator to avoid
this requirement not in serious crimes but in all crimes because of the difficulty of memorizing it, and we
have suggested to the Iraqi legislator to adopt the system of competent judge through which the court
acquires experience and know-how and sedition in the process of proof of criminal intent.
